Since working on the Shirley Tan case - I have receved numerous requests to assist Americans in same-sex binational relationships to remain together in the USA. When Defense of Marriage Act was made law, its impact was far reaching and serves to specifically exclude same-sex couples from the immigration laws of the USA. The absurdity of this and in my opinion unconstitutionality is evidenced by the fact tnhat some US States have legalized Gay Marriage and so there is this this rediculous anomaly created by the inability of the Federal government to provide equal treatment to all legally married couples.
There is legislation pending to change this. It is evolving and now with the introduction by Congressman Jerrold Nadler of the bill to repeal DOMA, "The Respect for Marriage Act," this could all change. There will be a big fight ahead.
